SOULMATES CARD

1. By registering and/or by using your Soul Origin Soulmates Card, you consent to the terms of this agreement.

2. To join the Soulmates program, you must be aged 16 years or older. For more information on Soul Origin’s policy for handling minor’s personal information, please refer to Soul Origin’s privacy policy (soulorigin.com.au/privacy-policy)

3. Free Coffee Voucher upon sign up is for regular hot coffee with regular milk. Changes to alternate milk, coffee size and syrup add-ons will be charged at an additional cost.

4. Soulmates’ Points will be awarded to customers for full priced products only, unless expressly specified.

5. To accrue a point, you must spend over $3 in a single transaction.

6. You will need to have 5 full priced transactions to receive 5 reward points. This will earn you a $5 reward which can be used on a subsequent visit. If you are registered as a Soulmate you will earn your first point towards your next reward on your next visit. Your $5 reward will expire 10 days from the date of issue.

7. To receive a reward, you must be registered as a Soulmate. To register, follow instructions provided in-store or on our website.

8. The transaction where you use a $5 voucher does not count as a point towards your next reward.

9. A reward cannot be used in conjunction with any other discount. Only one reward can be used in a single transaction.

10. A reward can only be used in a single transaction. Any remaining balance of the $5 reward will be cleared after the transaction. No change will be provided on the remaining balance and it does not carry over to your next reward.

11. While every effort will be made in store to ensure Soulmates’ Points and rewards are correctly awarded, Soul Origin takes no responsibility for technical errors associated with crediting points or rewards onto your Soulmates account.

12. Unless otherwise required by law or permitted by this agreement, any points or rewards balance on your Soulmates account is non-refundable and may not be redeemed for cash.

13. In the case of a lost or stolen Soulmates Card; Soulmates Members should contact Soulmates@Soulorigin.com.au and a Soul Origin team member will be able to transfer existing card information including Soulmates Points and rewards balances, to a new card. Every endeavor will be made to ensure that the full points balance is also transferred to the new card; however Soul Origin will not be responsible for any points accrued that are lost in the transfer. Cards that are reported as lost or stolen will immediately be cancelled and will be no longer able to be used.

14. We reserve the right to not to accept a Soulmates Card should we believe that the use is unauthorised, fraudulent or otherwise unlawful.

15. No fees will be charged by Soul Origin for the issue, registration, activation or use of the Soulmates Card.

16. Should a password be lost or forgotten, Soulmates should go to the Soulmates section of the Soul Origin website (soulorigin.com.au/Soulmates/) where they can enter their email address and click on ‘lost password’. Their password will then be sent to their nominated email address.

17. Soul Origin reserves the right to alter the terms and conditions of the Soulmates program at any time by notifying members through email or website.

18. Information collected from members at the time of signing up to the Soulmates program is subject to the privacy policy listed at soulorigin.com.au/privacy-policy.

1. GIFT CARD IS NOT REDEEMABLE FOR CASH.
2. IT CANNOT BE REPLACED IF LOST, STOLEN, OR DAMAGED.
3. GIFT CARD IS REDEEMABLE AT SOUL ORIGIN STORES IN NEW ZEALAND ONCE ACTIVATED. NOT AVAILABLE FOR USE ONLINE.
4. NO CHANGE WILL BE GIVEN AND ANY BALANCE THAT REMAINS ON THE CARD CAN ONLY BE USED IN WHOLE OR PART AGAINST A FUTURE PURCHASE AT SOUL ORIGIN STORES IN NEW ZEALAND.
5. THIS CARD EXPIRES 3 YEARS AFTER THE DATE OF ACTIVATION AND ANY UNUSED BALANCES WILL NOT BE REFUNDED OR CREDITED.

The Promoter accepts no responsibility for any entries not received for any reason during the Promotion Period.

Eligible Entrants: Entry is only open to New Zealand residents (Entrant).

How to Enter: To enter the Promotion, each Entrant must complete the following steps during the Promotion Period:

a) To be eligible for entry, each Entrant must ‘like’ the Promotion post on the official NZ Soul Origin Instagram profile (@soulorigin_nz);

b) The Entrant must follow the official Instagram accounts of Soul Origin NZ and Flight Centre:  @soulorigin_nz and @flightcentrenz;

c) The Entrant must tag at least (1) friend or family members in the comments section;

d) An Entry is deemed to be completed upon posting of the comment;

e) The Promoter is not responsible for incorrect, inaccurate, or incomplete information caused by an entrant or occurring during the uploading of an Entry. Further, The Promoter is not responsible for any entries that are not received or are otherwise interfered with due to problems with communications services.

Entries permitted: By completing the ‘How to Enter’ method, the entrant will receive one (1) entry (Entry).

Total Prize Pool: NZD $1,500

Prize Description: The total prize pool is:

1. 1 x $NZD 500* Soul Origin Gift Voucher; and
2. 1 x $NZD 1000* Flight Centre.

Prize Draw & Notification of Winners

On Monday 23rd December [GU1] 2024, the Promoter will announce the winners of the Promotion
(Winners).

The Winner will be contacted via direct message to the Winner’s Instagram
account. In the event of an unclaimed prize by 23rd
January 2024, the Promoter may at its discretion assign the prize to
the entry judged the next best entry, conduct a further judging to award the
prize, or withdraw the prize unawarded. The Promoter is under no obligation
to award any unclaimed prize.

The Promoter reserves the right at any time to verify any prize claims and
disqualify any Entrant who submits a prize claim that is not in accordance
with these Terms and Conditions. Errors or omissions may be accepted at the
Promoter’s discretion. Failure by the Promoter to enforce any of its rights
at any stage does not constitute a waiver of those rights.

If there is a dispute as to the identity of an Entrant or Winner,
the Promoter reserves the right in its sole discretion to determine the
identity of the Entrant or Winner.

1. The entrant agrees and acknowledges that they have read these
Conditions of Entry (and Schedule) and that entry into the Promotion is
deemed to be acceptance of these Conditions of Entry (and Schedule). Any
capitalized terms used in these Conditions of Entry have the meaning given in
the Schedule, unless stated otherwise.

2. The Promotion commences on the Start Date and ends on the End Date
(Promotion Period). Entries are deemed to be received at the time of receipt
by the Promoter and not at the time of transmission or deposit by the
Entrant. Records of the Promoter and its agencies are final and conclusive as
to the time of receipt.

3. Valid and eligible entries will be accepted during the Promotion Period.

4. All reasonable attempts will be made to contact the Winner.

5. If any Winner chooses not to take their prize (or is unable to) or does
not take or claim a prize by the time specified by the Promoter, or is
unavailable, they forfeit the prize and the Promoter is not obliged to
substitute the prize.

6. No part of a prize is exchangeable, redeemable for cash or any other prize
or transferable, unless otherwise specified in writing by the Promoter.

7. If a prize (or portion of a prize) is unavailable the Promoter reserves
the right to substitute the prize (or that portion of the prize) to a prize
of equal or greater value and specification.

8. No entry fee is charged by the Promoter to enter the Promotion. There is
no additional cost to enter the Promotion other than any cost paid by the
entrant to access the social media platform of entry via their Internet
service provider.

9. The prize will be awarded to the person named in the entry and any entry
that is made on behalf of an entrant or by a third party will be invalid. If
there is a dispute as to the identity of an entrant or winner the Promoter
reserves the right, in its sole discretion, to determine the identity of the
entrant or winner.

10. Entrants' personal information will be collected by the Promoter.
Personal information will be stored on the Promoter's database. By submitting
your Entry, you are accepting these Terms and Conditions and you are
expressly consenting to the Promoter using your information for future
marketing purposes regarding its products, including contacting the entrant
electronically. The Promoter is bound by the Australian Privacy Principles in
accordance with the Privacy Act 1988 (Cth) and its privacy policy which is
located at https://www.soulorigin.co.nz/
 and advertisements, the Promoter may
only publish the Winner's surname, initial and State/Territory.

12. Any guarantee or warranty given is in addition to any relevant statutory
guarantees and warranties and nothing in these Conditions of Entry restricts,
excludes or modifies or purports to restrict, exclude or modify any statutory
consumer rights under any applicable law including the Competition and
Consumer Act 2010 (Cth).

13. If for any reason any aspect of this Promotion is not capable of running
as planned, including by reason of communications network failure, bugs,
tampering, unauthorised intervention, fraud, technical failure or any cause
beyond the control of the Promoter, the Promoter may in its sole discretion
cancel, terminate, modify or suspend the Promotion and invalidate any
affected entries, or suspend or modify a prize.

14. The Promoter reserves the right, at any time, to validate and check the
authenticity of entries. Entries containing offensive or defamatory comments,
or which breach any law or infringe any third-party rights, including
intellectual property rights, are not eligible to win. The use of any
automated entry software or any other mechanical or electronic means that
allows an individual to automatically enter repeatedly is prohibited and may
render all entries submitted by that individual invalid.

15. The Promoter reserves the right to disqualify entries in the event of
non-compliance with these Conditions of Entry. In the event that there is a
dispute concerning the conduct of the Promotion or claiming a prize, the
Promoter will resolve the dispute in direct consultation with the entrant. If
the dispute cannot be resolved the Promoter’s decision will be final.

16. The Promoter will not be liable for any loss (including, without
limitation, indirect, special or consequential loss or loss of profits),
expense, damage, personal injury or death which is suffered or sustained
(whether or not arising from any person's negligence or willful misconduct)
in connection with this Promotion or accepting or using any prize, except for
any liability which cannot be excluded by law (in which case that liability
is limited to the minimum allowable by law).

17. The Promoter accepts no responsibility for any tax implications and the
entrant must seek their own independent financial advice in regard to the tax
implications relating to the prize or acceptance of the prize.

18. Failure by the Promoter to enforce any of its rights at any stage does
not constitute a waiver of these rights.
